Investigation Starts on Over 200,000 Ford Vehicles with Fuel Leak Concerns

McEldrew Purtell currently represents multiple clients affected by a secondary fuel filter leak in Ford vehicles, which poses an increased risk of engine fire. One week before the court ordered inspection and destructive testing in that first case, the National Highway Traffic Safety Administration (NHTSA) launched an investigation into over 200,000 Ford vehicles, mirroring claims made by the McEldrew Purtell team.

This investigation follows 27 complaints, including 12 reports of fires and four injuries. The evaluation focuses on Ford F-250, 350, 450, and 550 Super Duty vehicles equipped with 6.7L diesel engines from model years 2015 to 2021. Ford has yet to comment on the matter, but McEldrew Purtell’s partner and lead attorney, Dan Purtell, along with the catastrophic injury team and co-counsel, remain steadfast in pursuing justice for those affected by this case.

Propane Explosion Litigation: PA Suffers from Series Explosions

A series of devastating propane-related explosions have shaken Pennsylvania throughout 2023, especially in recent months. Despite propane companies claims that leaks and resulting explosions are rare, an overwhelming number of reported cases have occurred within the state over the last year – raising questions regarding safety, regulations, and maintenance. 

The latest explosion occurred in the afternoon on December 22nd at the AmericaGas Partners building in Beaver County, PA. Two propane tanks inside the AmeriGas storage garage erupted, causing a massive fire that destroyed the building. Fortunately, no one was on site at the time of this explosion. 

On the same night, December 22nd, Irishtown Fire Company was called to the scene of a propane gas explosion in Adams County, PA. Crews were called to the 100 block of Fish and Game Road in Oxford Township late Friday night for a report of a garage on fire. Firefighters arrived and found a garage fully involved in fire, spreading to multiple vehicles and causing personal injuries.

Less than a week before, on the morning of December 18th, a Lancaster County landmark, the Bird-in-Hand Family Inn exploded due to a propane gas leak. 61-year-old Michelle Miller lost her life in this tragic explosion. She was a long-time member of the community and served as the night auditor for the inn for 34 years. In addition to this wrongful death, the explosion and resulting fire caused close to $2 million in damages to the inn and adjoining restaurant. Thankfully, at the time of the incident the inn was vacant of guests due to scheduled annual pre-holiday maintenance. 

In September, a 68-year-old man died in a home explosion that reportedly lifted the home from its foundation. Though the investigation is still ongoing, there was strong suspicion that the explosion was caused by a propane leak in the house. 

On July 5th, the Rapho Township Maintenance building exploded due to a propane heater leak, destroying it and damaging nearly a dozen surrounding homes. The maintenance building belonged to the county and housed snow plows, dump trucks and other road maintenance equipment that the community needed, especially for the upcoming snow-season.

Seven people lost their lives and 11 others were injured on March 24th, at a candy factory in West Reading, PA when a natural gas pipeline exploded. In 2021, the utility company UGI Corp “exposed and retired” a brittle service line from 1982 but failed to properly disengage the retired line. Several leaks, both in the old and the new lines, were found by specialists after the resulting explosion.

Propane leaks result in an estimated 3000 fires and/or explosions in the United States every year – most commonly during the winter months when gas usage is up. Gas leaks can be the result of a variety of catastrophic failures including: 

  • Improper maintenance
  • Malfunctioning appliances
  • Broken gas lines
  • Worn-out connectors
  • Overfilled tanks
  • Corrosion, wear & tear of propane cylinders
  • Loss of odor additive 

Propane is a colorless, odorless gas that when mixed with oxygen can cause explosions and massive, rapidly burning fires. Odor additives are mixed with propane to alert of a problem. In rare cases, the additive degrades making it undetectable by smell or without proper equipment.

Homeowners, landlords and business owners are responsible for regular maintenance on all appliances, heaters, or other equipment that utilize propane as a source of energy. Rented tanks should be maintained by the gas company that services them to ensure that the tank is suitable for continued use. Often leaks are a result of improper maintenance, oversight, or manufacturer errors with a potential for a devastating outcome.

Awarded Top 20 for Wrongful Death Settlements

McEldrew Purtell was recognized in the Top 20 Wrongful Death Settlements in the United States in 2022 for the case Estate of Roberson vs. Covey. John J. Coyle and Daniel N. Purtell were awarded $7.5 Million to the Estate of Jemel Roberson aftering being wrongfully shot and killed by Midlothian Police Officer Ian Covey while responding to a shooting where Roberson worked as a security guard. Roberson was actively detaining the shooting suspect while on duty when he was shot and killed by the responding officer Covey even after being informed that Roberson was the security guard not the suspect. $1.6 Million Settlement: Wrongful Death in Prison

Our Civil Rights Team led by Mark V. Maguire reached a $2 million settlement for the estate of Marvin David Scott III, who was wrongfully killed by police officers while in custody.

Mr. Scott was under arrest for a misdemeanor of marijuana possession. He had a history of schizophrenia and while in custody at Collin County Detention Facility started to behave erratically, in a way consistent with a schizophrenic episode. The officers then tied him to a bed, placed a spit hood on him and pepper sprayed him. Mr. Scott became unresponsive and was pronounced dead shortly after.

The medical examiner’s report stated that the cause of death was “fatal acute stress response in an individual with previously diagnosed schizophrenia during restraint struggle with law enforcement.” This is an example of the county’s failure to maintain safe and civilized jails. Our firm is satisfied in knowing that after their tragic loss and a grueling legal process, the family received some comfort in seeing the county be held accountable for their actions.

$700,000 FELA Settlement

Colin S. Haviland, Esq. and Daniel N. Purtell, Esq. settled an FELA case for $700,000 on behalf of a client who suffered severe injuries as a result of his Railroad employer failing to supply the proper equipment to complete his job.

McEldrew Purtell’s client was directed to manually lift an excavator bucket weighing in excess of three hundred pounds, despite his employer having a rule its employees should lift anything over 55 pounds without the assistance of a machine.  Our firm is proud of our work on our client’s behalf because we secured the money he needed to get him back on his feet and provide his family the financial security they deserve.

$885,000 FELA Settlement

Attorney John. J Coyle settled an FELA case for $885,000 for a union railroad worker, John Felder, who suffered serious injuries on the job, while loading railroad ties.

Mr. Felder and a coworker were tasked with moving railroad ties onto a flatbed truck without the assistance of any appropriate equipment when the tie slipped out of the co-workers hand resulting in a serious injury to our client. McEldrew Purtell is proud to represent members of the railroad community to ensure safety, accountability and to secure the outcome that they deserve.

$1.25 Million Settlement: Civil Rights Matter Involving Wrongful Death During Police Encounter

Attorney Mark V. Maguire of our civil rights team secured $1.25 million for the estate of Damien Daniels, an Army veteran, wrongfully killed by police during a welfare check.

On August 25, 2020, Damien Daniels was shot twice in the chest by police officers dispatched to his home by his own family for a wellness check. Mr. Daniels, a combat veteran suffered from severe post traumatic stress disorder, was previously a subject of four mental-health related calls with no incident. Knowing the state of Mr. Daniels’ the family reached out to the Red Cross to perform the wellness check, they in-turn called the police department to encourage him to check in to the local VA hospital for assistance. The police unequipped for mental health assistance escalated, resulting in the wrongful death of our client.

Though nothing can bring Mr. Daniels back, his family receives restitution. The family and community knows that McEldrew Purtell’s Civil Right Teams would not rest without holding accountability for the untimely loss of their loved one. 

$2 Million Medical Malpractice Settlement

Marcus A. Washington, Esq. settled a medical malpractice case for $2 million to be paid to the estate of our client Tyrone Hanes.

Mr. Hanes suffered from a catastrophic automobile accident that left him with chronic pain and physical limitations. There was some promise for relief with a spinal fusion surgery routinely used to help correct the pain and damage from accidents like the one that he suffered.

After surgery Mr. Hanes was placed in a halo, a metal device that circles and attaches to the skull, designed to keep bones in your neck from moving. The halo was improperly fitted and ended up cutting off his airway, resulting in his wrongful death. While the family still grieves the unexpected loss of Tyrone, they saw justice in this complex medical malpractice case. 

$2 Million Settlement for Wrongful Death of an Infant

Our client, a new born child, was failing to thrive when the doctors told the parents that the child was fine. While feeding soon after, the child lost consciousness and was pronounced dead a few days later. While nothing will bring back their child, McEldrew Purtell is satisfied in knowing the family received the compensation they deserved and those responsible were held accountable for their loss.

$2 Million Settlement and Justice for Man Raped and Killed in Philly Prison

Armani Faison, 35, was incarcerated in Philadelphia’s Currran-Fromhold Correctional Facility for a mere shoplifting charge when things took a heinous turn. Mr. Faison was placed in a cell with Kevin Massey who has a history of violence and sexual assault on his prior cellmates. The night he was placed in the cell with Massey, Armani was brutally attacked and ultimately murdered. Surrounding prisoners overheard Faison screaming for hours while he was brutalized without any intervention because the cell block was not staffed with a single guard. This is an example of a complete failure of leadership within the correction facility and is emblematic of the City’s complete failure to maintain safe and civilized jails.

After their tragic loss and a grueling legal process, the family is finally seeing the city be held accountable for their neglect.  Armani’s family and the City of Philadelphia entered into a $2 million settlement to resolve the pending federal civil rights lawsuit. McEldrew Purtell partner John Coyle, who represented Armani’s family, stated: “Armani’s death was a completely avoidable tragedy. This settlement allows the family to move forward and grieve the loss of their loved one while also sending a message to the City that the neglect shown to individuals in its custody must be addressed.”
